1. Acceptance of Terms

By accessing or using TripCartIt ("the Service", "the Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you and TripCartIt, Inc. ("TripCartIt", "we", "us"). We reserve the right to update these Terms at any time with notice provided via email or in-app notification.

TripCartIt is an AI-assisted travel planning and booking platform that enables users to:

4.1 How bookings work

When you complete a booking through TripCartIt, you are entering into a contract directly with the relevant travel supplier (airline, hotel, activity operator, or car rental company). TripCartIt is not a party to that contract except as a payment facilitator.

4.2 Supplier terms

Each booking is also governed by the supplier's own terms and conditions, including their cancellation, amendment, and no-show policies. By completing a booking, you agree to those terms as well as these Terms. Supplier terms are available before checkout.

4.3 Booking confirmation

A booking is confirmed only when you receive a booking reference or confirmation number from TripCartIt. Until that point, no contract has been formed and no charges will be made.

5. Pricing, Fees & Payment

5.1 Price display

All prices displayed on TripCartIt are inclusive of our service fee. The price shown at the point of search is the total amount you will be charged β€” there are no additional fees added at checkout beyond the displayed total.

5.2 Service fee

TripCartIt applies a service fee to flight and hotel bookings. This fee covers platform operation, 24/7 booking support, and secure payment processing. The fee is incorporated into the displayed price and is non-refundable except where a booking was cancelled due to our error.

5.3 Currency & pricing accuracy

All prices are shown in USD unless otherwise indicated. Flight and hotel prices are live and subject to change until the booking is confirmed. TripCartIt is not responsible for price changes that occur between search and payment completion.

5.4 Payment security

Payments are processed by PCI-DSS Level 1 certified payment processors. TripCartIt does not store raw card numbers on its servers. By submitting payment, you authorize the charge for the total amount displayed.

6. Cancellation & Refund Policy

Important: Cancellation rights and refund eligibility are primarily determined by the individual travel supplier, not TripCartIt. Always check the fare rules and cancellation policy before completing a booking.

Cancellation policies for GetYourGuide activities vary by experience. The specific policy is shown before booking. Most experiences offer free cancellation up to 24 hours before the start time.

To cancel a booking, contact us at [email protected] with your booking reference. We will process your request within 2 business days and coordinate with the supplier on your behalf.

6.5 Refund processing time

Approved refunds are returned to your original payment method within 5–15 business days depending on your card issuer.

7. AI-Generated Content

TripCartIt's AI travel concierge (Trippy, powered by Anthropic Claude) generates trip itineraries, activity recommendations, packing lists, and travel tips. This content is provided for informational and planning purposes only.

9. Intellectual Property

All content on TripCartIt β€” including the AI system, user interface, branding, and trip planning tools β€” is owned by TripCartIt, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute our content without written permission.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. TripCartIt does not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not guarantee the accuracy of prices, availability, or AI-generated content.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TripCartIt shall not be liable for:

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to TripCartIt in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold TripCartIt, its officers, directors, employees, and agents harmless from any claims, losses, or expenses (including legal fees) arising from your violation of these Terms, your use of the Service, or your violation of any third party's rights.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. Class action lawsuits are waived.
